Although the scheduled trial was cancelled when the parties notified the court that the lawsuit was settled in principle, there are many exhibits and portions of deposition transcripts that were cited in the parties’ pre-trial briefs, which in this notice — filed with the court today — I argue are subject to the presumption of public access. The court records challenged in this notice are not currently available to the public.
The parties and any interested non-parties will have an opportunity to motion to maintain confidential treatment of the material challenged in this notice.
